Credit Counseling

Typically pertains to two occurrences within personal insolvency proceedings: (1) The "one-on-one or collective session" provided by a not-for-profit financial planning and debt advisory organization that individuals facing debt must participate in before submitting a petition under any section of the Bankruptcy Statute; and (2) the "educational program on personal fiscal administration" in chapters 7 and 13 that a person in debt is required to finish before a debt release is granted. Exemptions exist for both stipulations for specific classes of individuals in debt, urgent situations, or if the U.S. trustee or bankruptcy administrator has concluded that there are inadequate authorized debt advisory organizations accessible to offer the requisite guidance.
