Nondischargeable Debt
A liability that cannot be removed in bankruptcy. Examples include a residential mortgage, obligations for spousal or child support, specific taxes, debts from most government-funded or guaranteed educational loans or benefit overpayments, liabilities resulting from death or personal injury caused by operating a vehicle while impaired or under the influence of substances, and obligations for restitution or a criminal penalty included in a sentence following the debtor's conviction of an offense. Certain debts, such as those for funds or assets acquired through deceitful means and debts related to fraud or misappropriation while acting in a fiduciary role may be deemed nondischargeable only if a creditor promptly files and succeeds in a nondischargeability lawsuit.
